It is specified in advance that these conditions only apply to sales by ADAR.

ARTICLE 1

1.1- Unless otherwise stipulated, prices are quoted in Euros (€) tax included without handling and shipping costs. (See Delivery/ deadlines and costs).
1.2- ADAR reserves the right to change its prices at any time; however, the products will be invoiced at the price in force at the time the orders are recorded.
1.3 - The products delivered remain the property of ADAR until effective payment of the total amount due.

ADAR has the right to decline the acceptance of the order - for example in case of nonpayment of all sums due at the settlement date or in case of late payment of overdue bills.

ARTICLE 3

You acknowledge to have fully understood and accepted the hereby general conditions before making any order. The validation of your order is worth acceptance of these General Sales Conditions.
Unless proved otherwise, the data recorded by ADAR Générale Télécom Services constitute proof of all transactions by its customers with ADAR.

ARTICLE 4

Our offers of products and prices are valid for as long as they appear on the website and while stocks last. For products not stored in our warehouses, our offers are valid subject to availability.
In this latter case, information on the availability of products is supplied to you when you place the order. As this information comes directly from our commercial department there may be errors or modifications in exceptional cases.
In the event of unavailability of a product after placing the order, ADAR will inform the client by e-mail or by mail as soon as possible. Your order will be automatically cancelled and you will be immediately refunded if your bank account were output.

ARTICLE 5

5.1 General information
The articles bought on ADAR’s website are delivered to the delivery address indicated on the order form. When you order several items at the same time with different delivery dates, we will quote the latest date for the estimated delivery. ADAR reserves itself however the possibility of fragmenting the deliveries. Only dispatched products will then be debited from your account. The processing and shipping fees will only be invoiced once. In case of delay in shipment, an email will be sent.
All orders not shipped within 30 days of the order will be canceled unless otherwise announced in the offer of sale.
When paying by check, your order will be processed upon receipt of check and payment is received. Consequently, the delivery delay only applies once the cheque has been received and therefore can be changed from the day of the order placement.
5.2 - Delivery problems
You must notify the carrier and ADAR all reserves on the product delivered within 10 days of receipt of product.

ARTICLE 6

Payment can be made by:
- Bank card: Visa, MasterCard, American Express
- Cheque (must be issued by a bank domiciled in France or Monaco).
The cashing of the check is performed upon receipt of check. The bank cheque must be sent to ADAR-M.T.T. - 15 allées Jean Jaurès - 31000 TOULOUSE - France.

In the particular case of pre-ordered products, your credit card can be charged up to 3 business days before the dispatch of your order.

ARTICLE 7

Refunds for products in the cases referred to in Articles 5 and 8 will be made within less than or equal to 15 days after receipt of goods by us.Payment will be refunded, at customer’s discretion, either by crediting your bank account or by issuing a cheque in the name of the customer who has placed the order and to the address of invoicing.
No return for cash on delivery will be accepted for any reason.

ARTICLE 8

8.1 - You have 14 days from receipt to return a product that you are not satisfied with.
Return costs will be at your charge. Only the price of the bought products will be refunded. The returns should be sent to ADAR-M.T.T. - 15 allées Jean Jaurès - 31000 TOULOUSE - France.
This right to return will only be accepted for products in their original packaging, which are complete (packaging, accessories, instructions, etc.), in good condition and accompanied by a copy of the original invoice.
The items returned incomplete, damaged, spoiled or dirty by the customer will not be taken back.
The right to return does not apply to software with their cellophane wrappers removed by the customer or for services where performance has begun, with the consumer's prior express consent, before the end of the 14 days withdrawal period mentioned above.

ARTICLE 9

Our site uses a system of protection; we have adopted the SSL coding system, but we have also reinforced all the scrambling and encryption processes in order to ensure that all data relative to payment is protected to the highest possible extent.

ARTICLE 11

Some products such as software are subject to personal and specific rights regulating copying, public performances, hiring.
You must respect the general sales conditions of these products and ADAR cannot be held responsible for any use made of these products in this context.

ARTICLE 12

The products offered are in compliance with the French legislation in force. ADAR is not responsible in case of non-respect of the legislation of the country where products are delivered (if the product is prohibited…). It is up to the buyer to check near the local authorities the possibilities of importation or use of the products that you plan to order.
We suggest you to report to each product's description to see its detailed characteristics, and in case of doubt, or if you want further information, please contact us.
ADAR is only responsible for the content of pages it publishes.
ADAR therefore recommends that you contact our customer service directly with any question or concern regarding the products (Phone: +(33)5 61 63 60 60).
If purchasing on a professional basis, ADAR will not be held responsible for any indirect damages due to this contract, operating loss, loss of profit, loss of opportunity, damages or costs that may arise through the purchase of these products.
You are reminded that it is advisable to back up the data contained in the products purchased. ADAR will not be held responsible for any loss of data, files or damage defined in the previous paragraph. If it is not possible to use any or some of the products, particularly due to equipment being incompatible, there can be no claims for compensation or refund, and ADAR will not be held responsible.

ARTICLE 13

In all events, the customer will benefit from legal conformity guarantees and latent defects, and this, in compliance with the legal provisions in force.
The stipulations of this article do not prevent you from benefiting from the withdrawal right defined in article 8.
Contractual guarantee
Products purchased to ADAR may be entitled to a guarantee. It is shown on the sheet article products on the site. In order to find out how to submit an application for the after sales service in case of problem or product’s failure, the customer may contact the Customer service calling +33 (0)5 61 63 60 60.
To be able to benefit from the guarantee of products it is necessarily advisable to keep the invoice of purchase of the product.
The contractual guarantee does not cover:
- Replacement of consumables (batteries, hands-free sets, chargers, dynamo chargers).
- Incorrect or non-compliant use of products. In this regard, we invite the customer to consult carefully the instructions provided with the products.
- Breakdown linked to accessories (supply cables, etc.)
- Faults and their consequences due to a repairer not authorized by ADAR.
- Faults and their consequences due to external causes.
Whatever the case, you are covered by the standard terms of guarantee and in particular those relating to the legal guarantee mentioned in the article 13 above.

Article 1644 : Dans le cas des articles 1641 et 1643, l'acheteur a le choix de rendre la chose et de se faire restituer le prix, ou de garder la chose et de se faire rendre une partie du prix.
Article 1645 : Si le vendeur connaissait les vices de la chose, il est tenu, outre la restitution du prix qu'il en a reçu, de tous les dommages et intérêts envers l'acheteur.
Article 1646 : Si le vendeur ignorait les vices de la chose, il ne sera tenu qu'à la restitution du prix, et à rembourser à l'acquéreur les frais occasionnés par la vente.
Article 1647 : Si la chose qui avait des vices a péri par suite de sa mauvaise qualité, la perte est pour le vendeur, qui sera tenu envers l'acheteur à la restitution du prix et aux autres dédommagements expliqués dans les deux articles précédents. Mais la perte arrivée par cas fortuit sera pour le compte de l'acheteur.
Article 1648 : L'action résultant des vices rédhibitoires doit être intentée par l'acquéreur dans un délai de deux ans à compter de la découverte du vice. Dans le cas prévu par l'article 1642-1, l'action doit être introduite, à peine de forclusion, dans l'année qui suit la date à laquelle le vendeur peut être déchargé des vices ou des défauts de conformité apparents.
Article 2232 du code civil : Le report du point de départ, la suspension ou l'interruption de la prescription ne peut avoir pour effet de porter le délai de la prescription extinctive au-delà de vingt ans à compter du jour de la naissance du droit. Le premier alinéa n'est pas applicable dans les cas mentionnés aux articles 2226, 2227, 2233 et 2236, au premier alinéa de l'article 2241 et à l'article 2244. Il ne s'applique pas non plus aux actions relatives à l'état des personnes.

Garantie contractuelle
Les produits achetés sur ADAR Générale Télécom Services peuvent donner droit à une garantie. Celle-ci est indiquée sur la fiche article des produits présentée sur le site. Afin de connaître les démarches à suivre concernant le service après-vente pour tout problème ou de panne sur un produit vous pouvez contacter le Service clientèle au numéro de téléphone suivant : +(33)5 61 63 60 60. Pour pouvoir bénéficier de la garantie des produits, il convient impérativement de conserver la facture d'achat du produit.
Les garanties contractuelles ne couvrent pas :
- le remplacement des consommables (batterie, kit piéton, chargeur, chargeur dynamo),
- l'utilisation anormale ou non conforme des produits. Nous vous invitons à cet égard à consulter attentivement la notice d'utilisation fournie avec les produits,
- les pannes liées aux accessoires (câbles d'alimentation...),
- les défauts et leurs conséquences dus à l'intervention d'un réparateur non agrée par ADAR Générale Télécom Services,
- les défauts et leurs conséquences liés à toute cause extérieure.
Toutefois, en tout état de cause vous bénéficiez des dispositions de la garantie légale notamment celles relatives à la garantie légale précisée à l'article 13 ci-dessus.

ARTICLE 14

The hereby conditions are bound by the French Law. In case of a claim with professionals and/or sellers, the competent Court of Justice will be the one where ADAR has its head-quarters (Toulouse). In the event of litigation, the French courts will be only qualified.

ARTICLE 15

The information and data regarding you are required for processing your order and for our sales relations.
These may be transmitted to other companies who collaborate with us in fulfilling your order, to facilitate the management, execution, fulfillment and payment of your order.
This information and data is also stored for security purposes in order to comply with legal and regulatory obligations and as to enable us to customize and improve the services we offer and the information we send you. According to the Data Protection Act of January 6th, 1978, you have at any time, a right of access, rectification and opposition to all of your personal data by writing us a letter.
